Ownership

Chartanalytics.co.in, hereinafter referred to as the "Website", is free of any pending or threatened liens. All content, graphics, HTML, CGI, or other scripts displayed and used on the Website are privately owned by Foram Chheda, CMT (SEBI Reg. No. INH000007924), hereinafter referred to as the "Owner".

The disclaimer herein is for the benefit of Foram Chheda, CMT as much as for other Affiliates, Affiliate Companies, Partners, Distributors of Services, and Channel Partners.

Section 02

Purpose & Access

The Website has been launched and established with the purpose of providing research services — mandated and otherwise — in the capital markets and other related financial markets, to its clients. The Website and its Owners have exclusive and sole discretion to select the Customers and Clients who would be entitled to use, access, and benefit from the Service. The Owners also reserve the absolute right and discretion to decide on the criteria for selecting Customers to participate in the services offered on this Website.

Section 03

Nature of Services

The services offered by the Website envisage a Customer or Client who wishes to avail of the services, which are divided and classified into Service Packages and Standalone Services (hereinafter referred to as the "Offer"), by subscribing and making a payment in a mode as made available on the Website.

The Offer shall remain valid only for such period as may be determined by the Website and its Owners. The Owners reserve the absolute right to decide on the duration of the period during which the Offer shall be available. The Owners need not, and do not, and will not undertake to notify the withdrawal of the Offer.

The Active Trader Services are not customised in nature. The Client subscribes and receives buy or sell recommendations. The Client shall be responsible for using his or her own discretion in taking positions while keeping his or her risk profile in view. The Owners shall not be responsible in any manner for the Client's risk management with his or her brokers, as that is outside the purview of the services provided. The Client is expected to have basic knowledge of risk management before trading in the stock markets.

The Website and its Owners, in no way, provide any guarantee of earnings from the subscribed services.

Investment Disclaimer

This Service does not constitute an offer to sell or a solicitation to any person in any jurisdiction where it is unlawful to make such an offer or solicitation. This Service is not intended to be any form of investment advertisement, investment advice, or investment information and has not been registered under any securities law of any foreign jurisdiction.

The distribution of this Service or its content in other jurisdictions may be restricted by law. Persons who access this Service should inform themselves about and observe any such restrictions. Use of the Service is at any person's — including a Customer's or Client's — own risk. The data and information provided on the Website are usually compiled using great care; however, they may not be error-free.

The Website, its Owners, and other Affiliates, Affiliate Companies, Partners, Distributors of Services, and Channel Partners shall not be liable, legally or otherwise, for any loss or damage caused in any form or manner out of action initiated by the Subscriber, Client, or Customer based on the information provided by the Website or its Owners.

The Website, its Owners, and other Affiliates may have or may not have an outstanding buy or sell position or holding in the securities, options on securities, or other related investments of issuers and companies mentioned on the Website.

Information herein is believed to be reliable but the Website, its Owners, and other Affiliates do not warrant its completeness or accuracy. Clients and Customers are advised to peruse the articles and other data on the Website only as information and to rely on their own judgement when making investment decisions.

Investment Suitability

The investments discussed or recommended in the market analysis, research reports, or other content may not be suitable for all investors. Investors must make their own investment decisions based on their specific investment objectives and financial position, and use such independent advisers as they believe necessary.

Delivery of Services & Technology Disclaimer

The delivery of Services by the Website to its Clients and Customers is by email and SMS or WhatsApp messages or App notifications, and is technology dependent. The Website, along with its Owners, employees, Affiliates, Affiliate Companies, Partners, Distributors of Services, and Channel Partners shall not be liable for damages or injury arising out of or in connection with the use of the Website and its Subscribed Services or its non-use — including non-availability, email or SMS delivery failure (as this is service-provider dependent), or any compensatory, direct, indirect, or consequential damages, loss of data, income, or profit, loss of or damage to property, or interruption of business.

Client Responsibilities

The Client or Customer agrees to have satisfied himself or herself with the capabilities of the Website and its Owners to provide and deliver the Services to which he or she has subscribed.

The past performance of the Website or its Owners does not in any way guarantee future performance.

The Client or Customer is fully aware and in full knowledge of the nature of the risks involved in dealing with financial instruments and the damages or losses arising out of investment decisions made by him or her.

The Client or Customer undertakes to notify his or her change of address, email address, or phone number to the Website. The Website and its Owners shall not be responsible in any manner, legally or otherwise, for any interruption or non-delivery of services resulting from the failure of the Client or Customer to notify any such change.

Payment & Refund Policy

The Client or Customer understands that the payment made to avail of the Services offered by the Website and its Owners shall be non-refundable. No refunds shall be granted under any circumstances once the Client or Customer starts receiving the services.

Section 11

Third-Party Content

The Website, its Owners, and other Affiliates, Affiliate Companies, Partners, Distributors of Services, and Channel Partners make no guarantees or representations as to, and shall have no liability for, any electronic content delivered by any third party — including without limitation the accuracy, subject matter, quality, or timeliness of any electronic content on the Website.

Linked Sites

The Website, its Owners, and other Affiliates, Affiliate Companies, Partners, Distributors of Services, and Channel Partners shall not be responsible for the contents of any linked site or any link contained in a linked site, or any changes or updates to such sites. Links are provided only for convenience, and the inclusion of any link does not imply endorsement by the Website or its Owners.

Section 13

Limitation of Liability

The maximum liability of the Website, its Owners, and other Affiliates, Affiliate Companies, Partners, Distributors of Services, and Channel Partners shall be subject to the amount of fees paid by the Customer for the services availed of through the Website or in pursuance of the Offer or Service.

The Website, its Owners, and other Affiliates shall not be liable for any misrepresentation, falsification, deception, or for any lack of availability of services through the Website, even if the same are advertised on the Website.

Section 14

Intellectual Property

The Website and its Owners shall not be liable if the Customer downloads any information or software from this Website. The Website, its Owners, and other Affiliates, Affiliate Companies, Partners, Distributors of Services, and Channel Partners shall not be liable if the Customer makes a copy, modifies, uploads, downloads, transmits, republishes, or removes or obscures any intellectual property — including trademarks, copyrights, or other notices or legends contained in any such information — or otherwise distributes any service or content from this Website.

The Website or its Owners shall not bear responsibility if the Customer modifies or uses the content or services obtained from this Website for any purpose other than those permitted or intended.

Section 15

Jurisdiction

The services offered on the Website are subject to the jurisdiction only of the courts of the Republic of India at Mumbai.

The Website contains features of services currently being offered by the Website and its Owners and those intended to be offered in the future. The Website or its Owners intend to launch services confirming with the features listed on the Website; however, due to business need and regulatory requirements, the final launch may contain variations. Notwithstanding anything contained on the Website, the Owners may decide to postpone the offering of services or may even decide to withdraw any offering or currently offered service altogether.
